Pisqa’ 2461
1
“A man shall not take his father’s wife” (Dt.23:1).
On this basis they taught:
One may marry the near kin of
a woman he has raped or seduced
[and is not liable under the rules of incest].
But one who rapes or seduces
the near kin of a married woman
stands under liability [for execution].
A man may marry the near kin of
a woman raped or seduced by his father,
but if he married the near kin of
a woman raped or seduced by his son—
R. Judah says:
He stands under liability,
as he would for a
rape or seduction committed by his father.2
For this reason is it stated:
“A man shall not take his father’s wife” (Dt.23:1).3
